TERMS OF USE AND SALE

Acceptance of the conditions

Access to and use of the website www.eatsana.es (the "Platform") implies full acceptance of these Terms of Use and Sale.

If the user does not agree with them, they must refrain from using the Platform.

To place orders, you must be at least 18 years old and have the legal capacity to enter into contracts.

3. Products and purchasing process

Eatsana offers prepared meals and food products for online purchase with home delivery or in-store pickup.

All information regarding ingredients, allergens, and nutritional data is provided in accordance with Regulation (EU) 1169/2011.

The orders:

  • Placed before 10:00 a.m. → next-day delivery from 12:00 p.m.

  • Placed after 10:00 a.m. → delivery on the second day

  • Minimum order: €10

  • Prices include VAT.

  • Payment is made in full at the time of purchase using a secure system.

All orders are subject to availability and confirmation.


4. Delivery and pick-up

Deliveries are made via SEUR.

The customer is responsible for providing correct information and a working phone number.

In case of absence:

  • The carrier will attempt to contact the customer.

  • If delivery cannot be made for reasons attributable to the customer, the order will not be refundable due to the perishable nature of the product.

In-store pickup available at:
Calle Uranio 35, 29603 Marbella, Málaga.

Orders not picked up at the agreed time will not be refunded.


5. Food safety and preservation

  • All products are freshly prepared and transported refrigerated (≤ 4°C).

  • The customer must refrigerate the products immediately after delivery.

  • Responsibility for proper storage lies with the customer from the moment of delivery.

  • Products may be frozen at the customer's discretion and under their own responsibility.


6. Cancellations and complaints

Orders can be modified or canceled until 10:00 a.m. on the day before delivery.

After this period, cancellation will not be possible due to the start of the production process.

In the event of a damaged, incorrect, or incomplete product:

  • The customer must notify us within a maximum period of 24 hours.

  • You must provide supporting photographs.

After verification, Eatsana may offer:

  • Replacement of the product, or

  • Refund within a maximum period of 7 calendar days.


7. Exclusion of the right of withdrawal

In accordance with Article 103.d of Royal Legislative Decree 1/2007, the right of withdrawal shall not apply to the supply of goods that are liable to deteriorate or expire rapidly.

Since the products sold are perishable foods, returns are not accepted once delivered.


8. Force Majeure

Eatsana shall not be liable for delays, failures, or inability to perform resulting from circumstances beyond its reasonable control, including, but not limited to:

  • Power outages

  • Technical failures or breakdowns in facilities

  • Water supply interruptions

  • Fires, floods, or adverse weather conditions

  • Strikes or labor disputes

  • Logistical or carrier failures

  • Decisions or restrictions imposed by public authorities

In the event of force majeure preventing production or delivery:

  • The customer will be informed as soon as possible.

  • You may choose to reschedule or receive a full refund.

  • No additional compensation shall be payable for indirect damages.

If the technical incident could compromise food safety, the company may preventively cancel affected orders, guaranteeing the corresponding refund.


9. Liability

Eatsana shall not be liable for indirect damages, loss of profits, or damages arising from the use of the Platform.

The maximum liability for direct damages shall be limited to the amount actually paid for the order concerned.

Nothing in these conditions limits the consumer rights recognized by current legislation.


10. Intellectual property

All content on the website is owned by Eatsana or licensed for use.

Reproduction without express authorization is prohibited.


11. Data protection

The processing of personal data is governed by the Privacy Policy available on the website.


12. Online Dispute Resolution (ODR)

The European Commission provides an online dispute resolution platform available at:

https://ec.europa.eu/consumers/odr/


13. Applicable law and jurisdiction

These Terms and Conditions are governed by Spanish law.

In the event of a dispute, the parties shall submit to the courts and tribunals of the consumer's place of residence in accordance with current legislation.
